TERMS OF SERVICE

1. OVERVIEW
Welcome to GripMate™. These Terms of Service govern your use of gripmate.co.za and any purchases made through our online store.
The terms “GripMate,” “we,” “us” and “our” refer to the business operating this store. By accessing our website or placing an order, you agree to these Terms of Service, our Privacy Policy, Shipping Policy and Returns and Refunds Policy.
If you do not agree to these terms, please do not use our website.
2. ONLINE-STORE ELIGIBILITY
By using this website, you confirm that you are at least 18 years old or have permission from a parent or legal guardian.
You agree to provide accurate, current and complete information when placing an order. You are responsible for ensuring that your delivery address, contact number and email address are correct.
3. PRODUCTS AND DESCRIPTIONS
We make reasonable efforts to display and describe our products accurately. Product colours, packaging and appearance may vary slightly because of screen settings, manufacturing changes or product improvements.
We may update product descriptions, prices, specifications and availability without prior notice. These changes will not affect orders we have already accepted unless we contact you and agree otherwise.
All products are subject to availability.
4. PRODUCT USE
GripMate™ products must be used responsibly and according to any instructions supplied with the product.
The customer is responsible for determining whether the product is appropriate for their intended use. GripMate is not a medical device and should not be treated as a replacement for professional medical equipment or medical advice.
Nothing in these terms excludes any rights or remedies available to customers under applicable South African law.
5. ORDERS
Placing an order constitutes an offer to purchase the selected products.
An order is accepted once payment has been successfully processed and we send you an order confirmation.
We reserve the right to reject or cancel an order where:
• The product is unavailable
• The price or product information contains an obvious error
• Payment cannot be verified
• We reasonably suspect fraud or unauthorised activity
• Delivery to the supplied address is not reasonably possible
If we cancel an order after payment has been received, we will refund the amount paid.
Products purchased from GripMate are intended for personal use unless a separate resale or wholesale agreement has been arranged.
6. PRICES AND PAYMENT
All prices are displayed in South African rand.
Delivery charges will be shown during checkout before payment is completed. Unless specifically stated otherwise, promotional codes and discounts cannot be combined.
You confirm that you are authorised to use the payment method provided when placing an order.
Payments are processed through third-party payment providers. GripMate does not directly store complete credit- or debit-card details.
7. ORDER CHANGES AND CANCELLATIONS
Contact us as soon as possible if you need to change or cancel an order.
We cannot guarantee that an order can be changed or cancelled after it has been processed, packed or handed to the courier.
Any cancellation and return rights provided by the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable legislation remain unaffected.
8. SHIPPING AND DELIVERY
We currently deliver within South Africa unless otherwise stated.
Delivery periods shown on the website are estimates and may be affected by courier delays, public holidays, remote delivery locations, incorrect customer information or circumstances beyond our reasonable control.
Customers must provide a complete and accurate delivery address and ensure that someone is available to receive the parcel where required.
GripMate remains responsible for the order until it is delivered to the customer or an authorised recipient, subject to applicable law.
If tracking shows that an order was delivered but you cannot locate it, contact us promptly so that we can investigate with the courier.

9. RETURNS AND REFUNDS
Returns, exchanges and refunds are governed by our Returns and Refunds Policy and applicable South African consumer law.
Qualifying change-of-mind return requests must be submitted within seven days after receiving the product.
This seven-day period does not limit a customer’s rights relating to defective, unsafe, unsuitable or incorrectly supplied goods under the Consumer Protection Act or other applicable legislation.
Customers must contact info@gripmate.co.za before returning a product. Unauthorised returns may be delayed or refused where permitted by law.
10. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
Customers should inspect their orders after delivery and notify us promptly if a product is damaged, defective or incorrect.
We may request photographs, video, the order number and other reasonable information necessary to assess the issue.
Where a product is defective, unsafe or does not meet the standards required by South African consumer law, the customer may be entitled to a repair, replacement or refund.
Nothing in these terms limits the statutory warranty or remedies provided by the Consumer Protection Act.
11. PROMOTIONS
Promotions, discount codes and special offers may be subject to additional conditions displayed with the relevant promotion.
We may correct or cancel a promotion containing an obvious pricing, technical or publication error. If this affects an order that has already been paid, we will contact the customer and provide an appropriate refund where necessary.
Unless otherwise stated:
• Discount codes cannot be exchanged for cash
• Only one discount code may be used per order
• Promotions are available while stocks last
• Discounts cannot be applied retrospectively
12. INTELLECTUAL PROPERTY
The GripMate™ name, logo, website content, graphics, product photographs, videos, written material and other original content belong to GripMate or are used with permission.
You may use the website only for lawful, personal and non-commercial purposes.
You may not copy, reproduce, distribute, modify, sell or commercially exploit our content without prior written permission.
13. CUSTOMER REVIEWS AND SUBMISSIONS
If you submit a review, photograph, video, comment or other content, you confirm that:
• You created it or have permission to share it
• It is accurate and not misleading
• It does not violate another person’s rights
• It is not unlawful, abusive, defamatory or harmful
You grant GripMate permission to display and use submitted product reviews and related content for operating and promoting the business.
We will obtain additional permission before using identifiable customer content in paid advertising where reasonably required.
We may remove content that violates these terms.
14. ACCEPTABLE WEBSITE USE
You may not use the website:
• For unlawful or fraudulent purposes
• To transmit viruses, malicious code or harmful material
• To interfere with the website’s security or operation
• To collect personal information without authorisation
• To impersonate another person
• To submit false orders or payment information
• To infringe intellectual-property or privacy rights
• To extract website content for commercial use without permission
We may restrict or terminate access where we reasonably believe these terms have been violated.
15. THIRD-PARTY SERVICES AND LINKS
Our website may use services supplied by Shopify, payment providers, couriers and other third parties.
These third parties may process information necessary to provide their services. Their own terms and privacy policies may also apply.
Links to third-party websites are provided for convenience. We are not responsible for third-party content, products or services, except where applicable law provides otherwise.
Purchases made through our store are transactions between the customer and GripMate, not Shopify.
16. PRIVACY AND PERSONAL INFORMATION
We process personal information in accordance with our Privacy Policy and applicable South African data-protection legislation, including the Protection of Personal Information Act.
We may process information necessary to:
• Process orders and payments
• Deliver products
• Communicate with customers
• Prevent fraud
• Provide customer support
• Meet legal and accounting obligations
• Send marketing communications where permitted

17. WEBSITE AVAILABILITY
We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.
We may temporarily suspend or modify parts of the website for maintenance, security, upgrades or circumstances outside our reasonable control.
18. LIMITATION OF LIABILITY
To the extent permitted by South African law, GripMate will not be liable for indirect or consequential losses arising from website interruptions, misuse of a product or circumstances beyond our reasonable control.
We do not exclude or limit liability where doing so would be unlawful.
Nothing in these terms excludes a customer’s rights under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable South African legislation.
19. INDEMNITY
To the extent permitted by law, you agree to be responsible for losses reasonably arising from your unlawful use of the website, fraudulent conduct, infringement of third-party rights or material breach of these terms.
This provision does not require a customer to indemnify GripMate for GripMate’s own unlawful conduct, negligence or breach of applicable consumer law.
20. SEVERABILITY
If any provision of these terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply.
21. CHANGES TO THESE TERMS
We may update these Terms of Service when our operations, services or legal obligations change.
The latest version will be published on this page with its effective date. Changes will not retrospectively remove rights relating to orders already placed.
22. GOVERNING LAW
These terms are governed by the laws of the Republic of South Africa.
Any dispute will be handled by the appropriate South African court, tribunal, consumer authority or alternative dispute-resolution body with jurisdiction.
Customers may also have the right to approach the Consumer Goods and Services Ombud or National Consumer Commission.
